The nest you see is just a mossball. Here's a little hint:  focus on the middle section of the photo.

That could very well be a bird, the profile suggests it may be a small passerine hanging almost upside down eating some fruits or leaf gleaning insects.  But, I think it is very hard to know for sure based on this photo, let alone propose an ID.  Can you tell us anything else about this photo?

Yep - that's the bird.

@ Liam: Not a OCW or RCK, but it is a warbler. This was taken in August of last year.

Wilson's Warbler is a good guess.

If not, could it be a (female?) Yellow Warbler?
