Red-tailed Hawks don't have black eyes, definite falcon here.

So that's not the hallmark belly-band of a red-tailed that I'm seeing?
The belly band on the Red-tailed Hawk would probably be a bit more prominent. Red-tailed Hawks don't have the streaks on the breast either.

You can never use one mark to I.D. a bird.
While I agree with the sentiment here, never is a pretty strong word... the bill of a Toco Toucan comes to mind
