The throat's awfullly white for a Yellow-bellied. This is another species where the name is really misleading -- most of the Empies can show yellow bellies. What distinguishes Yellow-bellied (and "Western") is the throat color.

I shot this yesterday at Waukegan Beach in Illinois. I think the yellow color is exaggerated by the lighting, but note how the color continues up onto the throat, resulting in very little contrast with the cheek.
