Two very poor photos. A friend who knows raptors (breeds and keeps them) says this is a buteo but not a Rough-legged, which is the main Buteo here and actually saw at least one, maybe a pair, this same night. Could it be a Harlan's?
Had to post to my flikr account, this forum would not allow me to upload the photos. The second photo shows the tail better.

It could be a Harlan's. The bare legs exclude Rough-legged.
