This bird frequents my birdbath frequently and my best guess is a female Painted Bunting. The male has not come around and would really like to get his picture, but if this is some type of finch, I should not get my hopes up too high to see the male Painted Bunting.

First, I agree this is a Painted Bunting. I don't think we can say it's a female for sure -- if you notice at the corner of the bill there's a fleshy yellow structure? That indicates that this is a juvenile bird, and I don't think we can sex them at this age. (If it's not a Painted Bunting, then someone's been breeding and releasing exotic finches.)

not sure if this is painted,i see some red on the breast which i dont a juvie would have

I agree with painted. The darker color on the underside I believe is partly due to the reflection from the water (and bird bath).
