It looks like a Pine Warbelr to me

With that extensive yellow, looks good for a male Pine.

Doesn't that tail look a bit short for Pine?
It may just be the angle.
It does, but I figured it was the angle. I've never seen a Baypoll with that much yellow and I'm pretty sure I can make out some of the Pine's facial pattern. Another photo never hurts, though!

sorry, no more pics, my field ID was bay-breasted, is it just me or do you see some "bay" on the flanks?

I agree with Liam that the tail looks far too short for a Pine, but I don't think I can make a definitive ID. I'm guessing that the yellow in this case is a result of the lighting, in which case I don't trust any color on the flanks, either. The eyestripe looks a bit better for Blackpoll, but not enough for me to make a call. I guess this one comes down to how you feel about what you say in the field.
