i observed this bird for about ten minutes yesterday. it was ~ 50' high in a pecan tree and making short burts of flight flycatching. i was calling back and forth with it and its call was a slurred clear whistle: weee-aaarre (slightly ascending).............weeEE'rrrrree (descending at the rrrree end-part). from the call and the wing bars that are barely visible in the photo, the best i could come up with is eastern wood-pewee. any input is appreciated.

kimura was with me when we first heard the bird. but i finally got some shots a week later. we had it narrowed down to an eastern wood-pewee, but did not find it to confirm.
