On my walk by the Wildlife Preserve at Delta Park this morning this bird appeared. Do you know what it is?

Looks like a Falcon to me, but I've got a long way to go before I can identify anything more than a Robin. PS: I hope the bird is only gasping because of the heat and is not injured.   Ken
