black seems speckled breast In Orleans County NY

This poor thing was seen under my roof hanging onto the chimmney one night. These are standard size bricks on the side of my chimney. I thought it was a rough legged hawk but the tail is solid color not striped. Any ideas? I live in Fairfield, CA near Sacramento
